Changes are effective upon posting, and we will indicate the effective date below. This Privacy Policy is incorporated into, and part of, the Website Terms and Conditions. This Website is intended for users located in the United States, and is interpreted under the laws of the United States.

Navigating This Privacy Policy

The Information We Collect

We obtain information about you when you use our Services. Some information is necessary to provide the Services; if you do not provide it, or ask us to delete it, you may no longer be able to access all or part of the Services.

Information You Provide. We collect information you give us directly, including through account registration, questions and feedback you submit by email or online forms, participation in surveys, and requests for customer support. This includes your name, mailing address, and email address; billing information such as payment card details collected through our payment processors on our behalf; log-in credentials; information about your purchases and transactions; records of your customer service interactions; content you post in public areas of our Services; and any other information you choose to provide.

Information Collected Automatically. We and our service providers use cookies and similar technologies to collect information about your use of the Services and the devices you use to access them, including domain name, browser type, operating system, the pages you view and time spent on them, search terms you use on the Website, and similar data. We also collect general location information (such as the city, state, or postal code associated with an IP address) to provide accurate sales tax and location-relevant content. We use session-replay technology, described in the Cookies section below.

Information From Social Media. We maintain a presence on social media platforms. When you interact with us there, or sign up for a promotion through one of our social media accounts, we may collect your name, email address, and any content you post that is relevant to FloodGuard Vents.

How We Use Your Information

We use your information to operate and manage our Services, which includes verifying and administering your account, processing payments, fulfilling orders, communicating with you about your orders and inquiries, presenting our content effectively, enabling interactive features, and keeping our Services safe and secure. We also use your information to research and improve our Services, to understand the effectiveness of our advertising and content, and, where you have not opted out, to deliver and customize relevant advertising. We may combine the information we collect with information from other sources and use it as described in this Privacy Policy, and we may aggregate or de-identify information and use it for any purpose.

Cookies, Tracking, and Your Consent

Cookies are small data files stored in your browser. We and our service providers use cookies, web beacons, tracking pixels, SDKs, server logs, and similar technologies to operate the Website, remember your preferences, measure and analyze usage, support security and fraud prevention, and, where permitted, deliver and measure advertising.

Session-replay technology. We use Microsoft Clarity, a session-replay and analytics service. This technology may record your interactions with the Website, such as mouse movements, clicks, scrolling, and the pages and content you view, so that we can understand how visitors use the site and improve it. We do not use it to intentionally capture sensitive information you enter, and these recordings are used for analytics and product-improvement purposes.

Your consent and choices. Where required, we deploy non-essential cookies and tracking technologies, including analytics, advertising, and session-replay tools, only after you provide consent through the cookie banner presented on the Website, and you can change your preferences at any time through that banner or your browser settings. You can also set your browser to refuse or notify you about cookies, though parts of the Website may not function properly if you do. By using the Website and accepting cookies through the banner, you consent to the use of these technologies as described here.

Live Chat and Communications Monitoring

When you communicate with us by email, online form, or any live chat or messaging feature we make available, we may monitor, record, and store those communications, and the information you provide in them, to respond to and support you, maintain records, train and evaluate our team, prevent fraud and abuse, and improve our Services. If we make live chat available, it may be provided through a third-party service provider (such as Gorgias) that processes and stores chat communications on our behalf. By using these communication features, you consent to this monitoring, recording, and storage. If you do not consent, please do not use these features and instead contact us by mail at the address below.

Data Analytics and Advertising

Analytics. We use third-party analytics services, including Google Analytics (and features such as Google Signals and Google User-ID) and Microsoft Clarity, to collect and analyze usage information through cookies and similar tools, to conduct research and reporting, to support fraud prevention, and to recognize users across browsers or devices where applicable. To prevent Google Analytics from using your information, you can install the Google Analytics Opt-out Browser Add-on, and you can manage Google ad personalization through your Google account settings. If you receive email from us, we may use analytics tools to capture whether you open a message or click a link, so we can measure the effectiveness of our communications.

Advertising. We integrate third-party advertising technologies, including Meta and Google advertising services, that use cookies and similar technologies to deliver relevant content and advertising on our Services and on other websites and applications you use. These ads may be based on your activity over time and across other websites and services. We sometimes provide customer information such as email addresses to service providers who match it, in de-identified form, to identifiers in order to show you more relevant ads. We do not control, and this Privacy Policy does not govern, tracking technologies placed by non-affiliated third-party advertising networks.

You can opt out of interest-based advertising from participating companies through the Network Advertising Initiative opt-out page and the Digital Advertising Alliance opt-out page. If you exercise these opt-outs you will still see advertising, but it will not be tailored to you based on your activity over time.

How We Share Your Information

We may share your information as follows:

Service Providers. We share information with third parties who perform services on our behalf, such as billing and payment processing, marketing and advertising, analytics, customer service, shipping and fulfillment, data storage, IT and security, fraud prevention, and legal services.

Affiliates and Related Entities. We may share information with our affiliates and related business entities to deliver products and services and to provide a consistent level of service.

Legal Compliance and Protection. We may access, retain, and disclose information if reasonably necessary to comply with a subpoena, court order, or legal process, to enforce our Terms or this Privacy Policy, or to protect the rights, property, or safety of FloodGuard Vents, our users, or others.

Business Transfers. If we are involved in a merger, acquisition, financing, or sale of assets, your information may be among the assets transferred.

Public Forums. Information you post publicly, such as a product review, is not confidential and may be displayed on our websites and third-party sites and may be accessible through search engines. Please take care when using these features.

Sale or Sharing for Targeted Advertising. Some of the advertising and analytics activity described above may be considered a "sale" of personal information or "sharing" or "targeted advertising" under certain state privacy laws. You can opt out of this activity as described in Your Privacy Rights and through the Global Privacy Control, described below.

Your Privacy Rights

Depending on where you live, you may have rights under your state's privacy law. Several U.S. states, including California, Virginia, Colorado, Connecticut, and a growing number of others, have comprehensive consumer privacy laws. If you are a resident of such a state, you may have the right to:

  • Confirm whether we process your personal information and access that information;
  • Correct inaccuracies in your personal information;
  • Request deletion of your personal information;
  • Obtain a portable copy of personal information you provided;
  • Opt out of the sale of your personal information, the sharing or processing of it for targeted advertising, and certain profiling;
  • Limit the use of sensitive personal information; and
  • Not receive discriminatory treatment for exercising your rights.

To exercise any of these rights, contact us at support@floodguardvents.com or by mail at the address below. We will verify your request, which may require confirming information we already hold about you, and respond within the time required by applicable law. You may use an authorized agent to submit a request on your behalf where the law permits.

Appeals. If we decline to act on your request, you may appeal by replying to our response or emailing support@floodguardvents.com with the word "Appeal" in the subject line. We will respond to your appeal within the time required by applicable law. Depending on your state, you may also have the right to contact your state attorney general if you have concerns about our response.

Financial Incentives

We may offer a discount or similar benefit when you sign up for our email list or otherwise provide your information for marketing. Where this is considered a financial incentive under applicable law, the material terms are that, in exchange for your email address and consent to marketing, you receive the stated discount or offer. Any difference in the price or service we provide is reasonably related to the value of the information to us. Participation is voluntary, and you can withdraw at any time by unsubscribing or contacting us, after which the incentive will no longer apply.

Email Communications

If you opt in to our marketing emails, by submitting your email through a signup form, checking a consent box, or otherwise affirmatively requesting them, we will send you communications about our products, promotions, and offers. We do not share your email with unrelated third parties for their own marketing. You can opt out at any time by clicking the unsubscribe link in any marketing email; please allow a few business days for processing. Even if you opt out of marketing email, we may still send transactional messages about your orders, such as order confirmations and shipping notifications.

Do Not Track and Global Privacy Control

Some browsers offer a "Do Not Track" (DNT) signal. Because there is no common industry standard for DNT, we do not respond to DNT signals. However, we recognize the Global Privacy Control (GPC) as a valid opt-out of the sale and sharing of personal information and of processing for targeted advertising for residents of states whose laws provide that right. If you enable GPC in a supported browser or extension, we will treat it as an opt-out request for the browser or device on which it is enabled.

Data Retention

We retain personal information for as long as needed to provide the Services, maintain your account, comply with our legal, tax, and accounting obligations, resolve disputes, prevent fraud, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete, anonymize, or securely store it, consistent with applicable law.

Sensitive Information

We do not seek to collect sensitive personal information, such as government identifiers, precise geolocation, or financial account details beyond what our payment processors require to complete a purchase. Please do not send us sensitive information except as necessary to complete a transaction or as we specifically request.

Third-Party Links and Content

The Website and emails you receive from us may contain links to third-party websites. We are not responsible for the privacy practices or content of those websites. The inclusion of a link does not imply our endorsement. Please review the privacy policies of any third-party sites you visit.

Data Security

We implement reasonable and appropriate security measures consistent with prevailing industry standards to protect information from unauthorized access. However, no transmission over the Internet or method of storage is completely secure, and we cannot guarantee the absolute security of information you transmit to us or that we store.

Submitting Information From Outside the United States

We control and operate the Website from within the United States, and our Services are directed only to users in the United States. Information collected through the Website may be stored and processed in the United States. We do not target or tailor the Website or Services to, or knowingly do business in, the European Economic Area, the United Kingdom, or Switzerland, and we do not ship to those regions. If you access the Website from outside the United States, you do so on your own initiative, and you acknowledge that your information will be handled in accordance with this Privacy Policy and U.S. law. The English-language version of this Privacy Policy controls.

Children's Privacy

Our Website and Services are not directed to, and are not intended to be used by, children under the age of 18, and certainly not by anyone under 13. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from someone under 18, we will delete it. We encourage parents and guardians to talk with their children about safe use of the Internet.

Changes to This Privacy Policy

We may change or update this Privacy Policy from time to time. All information collected is subject to the Privacy Policy in effect at the time of collection. We will indicate the effective date at the top of this Privacy Policy, and where appropriate or legally required, we will provide additional notice of material changes. Please check this page periodically.
